TERMS OF SERVICE, CARRIER LIABILITY & PRIVACY POLICY

Airborne Freight Lines Inc.
Effective Date: December 20, 2025

Airborne Freight Lines Inc. (“Carrier,” “Airborne Freight Lines,” “Company,” “we,” “our,” or “us”) is a licensed motor carrier authorized to provide intrastate transportation within California and interstate transportation throughout the United States. These Terms govern all transportation services, website use, and contractual relationships unless otherwise agreed to in a separate written Carrier Agreement.

1. Carrier Status

Airborne Freight Lines Inc. operates solely as a motor carrier and does not act as a broker, freight forwarder, shipper, consignee, or warehouseman unless expressly stated in writing.

Acceptance of freight by Airborne Freight Lines constitutes acceptance of these Terms.

2. Governing Law & Federal Preemption

  • Interstate shipments are governed exclusively by the Carmack Amendment (49 U.S.C. §14706).
  • Intrastate shipments within California are governed by applicable California law.
  • Federal law shall preempt state law where applicable.
     

3. Scope of Services

 

Airborne Freight Lines Inc. provides motor carrier transportation services for:

  • Dry food products
  • Non-hazardous general freight
     

Frozen or temperature-sensitive freight may be accepted only by prior written agreement and subject to equipment availability.

Unless expressly stated in a written agreement signed by an authorized officer of Airborne Freight Lines:

  • Carrier does not guarantee temperature maintenance
  • Carrier assumes no liability for temperature variance
  • Shipper remains solely responsible for product quality, integrity, and compliance with all FDA, USDA, and state food safety regulations
     

Carrier does not provide refrigerated, frozen, or temperature-controlled services as part of its standard offering.

4. Shipper & Broker Responsibilities

The shipper and/or broker is solely responsible for:

  • Accurate freight description and classification
  • Proper packaging, labeling, and secure loading
  • Compliance with all applicable federal, state, and local laws
     

Carrier is not responsible for damage caused by:

  • Improper packaging
  • Shipper-loaded freight
  • Inherent nature of the goods
  • Concealed damage
     

5. Broker Acknowledgment & No Expanded Liability

Carrier does not accept:

  • Any increased or declared value
  • Any waiver of Carmack protections
  • Any special liability terms
     

Unless expressly agreed to in writing and signed by an authorized officer of Carrier.

Any broker or shipper contract attempting to impose liability beyond Carmack is expressly rejected unless separately negotiated.

6. LIMITATION OF LIABILITY (BROKER-CRITICAL)

To the maximum extent permitted by law:

  • Carrier’s liability for cargo loss or damage is limited to that required under the Carmack Amendment.
     
  • Carrier shall not be liable for:
     
    • Consequential, incidental, indirect, or special damages
    • Lost profits, market loss, or business interruption
    • Delay damages
       
  • Carrier’s maximum liability shall not exceed the freight charges paid or the statutory minimum, whichever is less.
     

7. Claims & Notice Requirements

All cargo claims must:

  • Be submitted in writing
  • Include supporting documentation
  • Be filed within applicable statutory timeframes

Failure to strictly comply with claim requirements constitutes waiver of the claim.

8. Indemnification (Strong Broker Protection)

Shipper and/or broker agrees to defend, indemnify, and hold harmless Airborne Freight Lines Inc., its owners, officers, drivers, and agents from any claims, damages, fines, penalties, or expenses arising from:

  • Mis declared freight
  • Improper packaging or loading
  • Regulatory violations
  • Hazardous materials tendered without disclosure
  • Broker or shipper contractual obligations beyond Carrier’s scope
     

9. Insurance

Carrier maintains insurance coverage in compliance with:

  • FMCSA minimum requirements
  • Applicable California law

Certificates of insurance may be provided upon request.
Carrier does not provide cargo insurance beyond statutory requirements unless expressly agreed in writing.

10. Force Majeure

Carrier shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to:

  • Weather conditions
  • Traffic congestion
  • Port delays
  • Labor disputes
  • Mechanical failures
  • Government action
  • Acts of God
     

11. Website Use Disclaimer

Information on this website is provided for general informational purposes only and does not constitute a contractual guarantee. Carrier reserves the right to modify services at any time.

12. Privacy & California Consumer Rights

Carrier complies with the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).

  • Personal information is used solely for business operations
  • Carrier does not sell personal information
  • California residents may request access or deletion of personal data
     

13. Venue & Jurisdiction (VERY IMPORTANT FOR BROKERS)

Any legal action arising from Carrier services shall be:

  • Governed by the laws of the State of California
  • Brought exclusively in Los Angeles County, California
     

14. Severability

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

15. Policy Updates

Carrier reserves the right to modify these Terms at any time. Continued tender of freight constitutes acceptance of revised Terms.
